WARRANTY TERMS & CONDITIONS — Repair & Service Jobs

For purposes of these terms, "Contractor" means IRBIS Air, Plumbing & Electrical and "Owner" means the customer identified in the proposal, invoice, or service agreement.

1. Coverage and Duration

Provided payment has been made in full, Contractor warrants the labor performed during HVAC service, maintenance, or repair for the warranty period stated on the invoice or service agreement (30 days, 90 days, 6 months, 1 year, or 3 years, as applicable). Any replacement parts are covered solely by the manufacturer's warranty, unless otherwise stated in writing. This warranty applies only to the specific repair or service performed and does not extend to unrelated system components or to future failures caused by normal wear and tear. This is the only warranty Contractor makes to Owner and is given in lieu of all other warranties, express or implied.

2. Owner's Maintenance Obligations

To maintain warranty coverage, the Owner must:
– Operate the equipment in accordance with the manufacturer's recommendations;
– Replace or clean air filters at the recommended intervals;
– Perform all required routine maintenance, including professional maintenance when recommended by the manufacturer;
– Provide maintenance and service records upon Contractor's request.

3. Reporting a Claim and Response

The Owner must notify Contractor promptly upon discovering any warranty concern and before additional damage occurs. Upon receipt of a valid claim, Contractor will make reasonable efforts to respond within twenty-four (24) business hours and to schedule on-site service within ninety-six (96) business hours, subject to technician availability, weather conditions, and emergency service demand. Warranty service is performed during Contractor's normal business hours, 8:30 a.m. to 4:30 p.m., Monday through Friday, excluding holidays.

4. Exclusions

This warranty does not cover failures or damage resulting from:
– Lack of required maintenance;
– Dirty or clogged filters, coils, or drains;
– Neglect, misuse, abuse, improper operation, or continued operation of the equipment after abnormal conditions are observed (including refrigerant leaks, freezing, unusual noises, electrical issues, or reduced performance);
– Power surges, electrical supply issues, flooding, fire, weather events, acts of God (including but not limited to earthquake), or other conditions beyond Contractor's control;
– Existing conditions or failures unrelated to the original repair;
– Refrigerant leaks occurring in locations not repaired during the original service visit;
– Unauthorized repairs, alterations, adjustments, or modifications performed by others;
– Damage caused by pests, corrosion, contaminated refrigerant, poor indoor air quality, construction debris, or improper installation performed by another contractor.

5. Continued Operation and Duty to Mitigate

Continued operation of a malfunctioning system that results in additional damage may void warranty coverage for the resulting damage. The Owner must take reasonable steps to mitigate damages upon discovering any defect or malfunction.

6. Limitation of Liability

Warranty service is limited to correcting defects in the original workmanship or covered repair. Contractor shall not be liable for electrical or other damage to drywall, stucco, roof, carpet, tile, flooring, windows, fixtures, furniture, or personal property arising from any defect or from any delay in responding to a warranty claim. Contractor shall not be liable for lost profits or for any incidental, special, exemplary, indirect, or consequential damages — including loss of use, loss of business, spoiled inventory, water damage, or increased utility costs — resulting from any work performed or from any problem, whether or not covered by this warranty.

7. Manufacturer Parts and Post-Warranty Labor

Manufacturer warranties on replacement parts remain subject to the manufacturer's terms, conditions, and approval procedures. Labor required to replace manufacturer-warranted parts after Contractor's labor warranty has expired may be billed at Contractor's current service rates, unless otherwise specified in writing.

8. Acts That Void the Warranty

Any repair, adjustment, diagnosis, or modification performed by an unauthorized or unqualified third party without Contractor's written approval will void the labor warranty for the affected repair.
